Abstract: The statute of limitations system should be the criminal law system inherently. However, in China, the administrative law also has a prescribed statute of limitations. This paper will conduct comparative study to clarify how the prescribed statute of limitations of criminal laws and administrative laws in China differ and which are the same. Specifically, this paper compares these two articles, history, the criteria for completion of the statute of limitations and the reasons for legislation, and concludes. In the conclusion of this paper, the administrative penalty is in the same line in China, although the grade is lower than the penalty, if there is a prosecution aging system in the criminal law, naturally the administrative law also has a prosecution aging system, both In fact, it states that it is basically an aged prescription system.
